Terms of Service
AthletECO Sports Terms of Service
Effective date: [EFFECTIVE DATE]
1. About these terms
These terms are an agreement between you and AthletECO Sports, LLC, a [STATE] limited liability company ("AthletECO", "we", "us"). They apply when you use athletecosports.com, athletecosports.app, any related site or app, and the GameStation scoring consoles and on-site services we provide at events (together, the "Services").
By creating an account or using the Services, you agree to these terms and to our Privacy Policy. If you are agreeing on behalf of an organization, club or business, you confirm you have authority to bind it, and "you" includes it.
If you do not agree, do not use the Services.
2. What AthletECO is, and what it is not
AthletECO provides software and equipment that tournament directors, clubs, coaches, trainers and families use to organize youth basketball: registration, schedules, brackets, scoring, rosters, invoices, bookings and player records.
We do not run the events you find here, unless we say so in writing. Tournaments are run by their tournament director's organization. Teams, practices, tryouts and open gyms are run by their club or coach. Training sessions are run by the trainer. Each of them (an "Organizer") sets their own rules, prices, refund policy, eligibility requirements and safety practices, supervises the people at their events, and is responsible for them.
We do provide some services directly at events: renting and operating scoring consoles, on-site staff, athlete measurements ("combine" testing), identity verification, and merchandise. Section 13 covers those.
3. Accounts
Eligibility. You must be at least 18 to create an account, except that:
- a child 13 to 17 may create an Athlete account with the permission of a parent or legal guardian, who agrees to these terms for them; and
- a child under 13 may not create an account. A parent or legal guardian creates and controls their child's athlete record.
Your information. Give accurate information and keep it current. One account is for one person; do not share your login.
Security. You are responsible for activity on your account. Tell us promptly at kurtis@athletecosports.com if you think someone else has used it.
Roles. An account may hold several roles, such as Parent and Coach. Some roles are available to anyone. Others — Tournament Director, Club, Trainer and Recruiting Coach — are granted only after we review an application, and we may decline or remove them at our discretion.
Scoring consoles. A GameStation signs in as a device, not as a person. Only people authorized by the event's Organizer may operate one.
4. Parents, guardians and athletes
If you add, claim or manage an athlete, you confirm that you are that athlete's parent or legal guardian, or that you are the athlete and are 18 or older.
Claiming an athlete. A coach may create an athlete on a roster using a name and jersey number. A parent or guardian takes responsibility for that record by entering the code printed on the athlete's card. Enter a code only for your own child or a child in your legal care. Claiming a child who is not yours is a serious breach of these terms, and we will report it where the law requires or permits.
What a guardian controls. A guardian may supply and correct their athlete's birthdate, grade, school, experience and emergency contact, answer availability, book training, pay invoices, add social media handles, and sign waivers for their athlete. Where two guardians are linked to one athlete, each may act independently.
What a club may do. The staff of an approved club may enter a missing birthdate and the other registration details for athletes on its teams, and see their guardians' contact details, because the club is responsible for its players' age eligibility. A birthdate a club enters is recorded as the club's; a verified birthdate cannot be changed by a family or a club.
Adult athletes. An athlete who is 18 or older may act for themselves, including booking training.
5. What is public
Youth basketball is played in public, and some of what we record is published. Anyone, with or without an account, can see:
- schedules, live scores, final scores, brackets and standings;
- team rosters: each athlete's first and last name, jersey number, position and team;
- each athlete's scoring in a game, and the box scores derived from it;
- an athlete's public card: name, club, jersey, age group, whether their identity has been verified, their badges and points;
- rankings and leaderboards, for the 13U age group and older only;
- public pages that approved clubs, trainers and coaches choose to publish.
We do not publish an athlete's birthdate, grade, contact details or social media handles, and we never offer a way to message an athlete. See the Privacy Policy for the full list.
6. Organizers
If you use the Services to run a tournament, club, team, tryout, open gym or training business, you are an Organizer, and in addition to the rest of these terms you agree that:
- you are responsible for your events, including the venue, supervision, officials, safety, emergency plans and first aid;
- you hold the insurance, permits and sanctions your events require;
- you comply with the laws that apply to you, including laws on youth sport safety, abuse prevention and mandatory reporting, background checks for the adults you engage, and consumer protection;
- the information you publish (dates, locations, prices, eligibility, refund policy) is accurate;
- you will use athletes' and families' information only to run your events, as described in the Privacy Policy, and protect it once you take it off the platform (for example, a tryout list you export);
- your waivers, codes of conduct and policies are your own. We carry their text; we do not write it or give legal advice about it.
Approval. We review applications from tournament organizations, clubs and trainers. Until approved, an organization may set up its events but may not publish a schedule, accept a registration, or take money. Approval is not an endorsement, a certification or a safety guarantee.
7. Trainers
Trainers listed in Find a Trainer are independent. They are not our employees or agents.
Before listing a trainer, we require a current background check and a current safeguarding training record from a provider we accept, and we record the outcome (not the report). A trainer whose check or training expires is removed from the listing automatically. This screening is limited. It does not guarantee a trainer's conduct, qualifications or suitability, and families should make their own judgment, supervise as they see fit, and report concerns to us and to the authorities.
Only a parent or guardian may book training for a minor. An athlete may book for themselves only if they are 18 or older.
A trainer who meets a family through AthletECO agrees to continue taking that family's bookings and payments through AthletECO for [PERIOD, e.g. 12 months] after the first booking. See section 9.
8. Fees and payments
Prices. Organizers set their own prices — tournament entry, club dues, tryout fees, training sessions and packages — and their own refund policies.
Platform fee. Organizers use our tools without a subscription. In exchange, AthletECO earns a fee on money paid through the Services: [PERCENTAGE, currently planned at 10%] of registration and other fees, as shown in the Organizer's account before they publish a price. We may change the fee on [NOTICE PERIOD] notice; a change does not apply to an event already open for registration.
Payments recorded by an Organizer. Until card payments are available, an Organizer may record a payment received by cash, check or transfer. When recorded, it is subject to the platform fee as if paid through the Services.
Records. Payment records are permanent. A mistake is corrected by a refund or an adjustment that records its reason; a record is never edited or deleted.
Refunds. Refunds are the Organizer's decision, under their published policy. Where AthletECO processed a payment, we will process a refund the Organizer approves. [CHARGEBACK AND DISPUTE HANDLING — TO DRAFT WITH PAYMENT PROCESSOR TERMS.]
Taxes. Organizers are responsible for taxes on what they charge.
9. Keeping payments on the platform
The Services are free for Organizers because AthletECO is paid a share of what is processed through them. You agree not to avoid that fee. In particular, you will not:
- list a price of zero, or a nominal price, while collecting the real price another way;
- discount everyone, or nearly everyone, to zero or near zero while collecting payment outside the Services;
- record a payment as cash, check or transfer, or as waived, to avoid the fee;
- direct families or teams you meet through the Services to pay you elsewhere, or (for trainers) to book with you elsewhere within the period in section 7.
Genuine discounts are allowed. Scholarships, financial assistance, a coach's own child, siblings, volunteers and staff are ordinary and welcome, and discount codes and individual discounts exist for exactly that.
Review. We may review activity, pricing, discounts and payment records to check compliance, including by automated rules that flag patterns for a person on our staff to look at. A flag is not a finding; a person reviews it before we act.
Remedies. If we reasonably conclude you have avoided the fee, we may, after telling you and giving you a chance to respond: invoice you for the fee on the payments involved; require future payments to be taken through the Services; and suspend or close your account.
10. Discounts
Organizers may create discount codes and give individual discounts from 0 to 100 percent, and may limit how many times a code is used and when it expires. A discount reduces the price the family pays; unless we agree otherwise, the platform fee is calculated on the price after the discount. Discounts do not combine unless the Organizer says so.
11. Acceptable use
You agree not to:
- contact, meet, photograph or follow a minor you found through the Services, other than as their parent, guardian, coach, club staff or booked trainer acting in that role;
- claim an athlete who is not yours, or impersonate anyone;
- harass, threaten, demean or discriminate against anyone;
- post anything unlawful, sexual, violent, or that shares someone else's personal information without permission;
- upload images of athletes (athlete photos are taken only by our staff);
- misstate scores, statistics, ages, grades or eligibility;
- copy, scrape or bulk-download data from the Services, or use it to build a competing service, a recruiting database or a marketing list;
- probe, test or bypass security, or access data you are not entitled to;
- interfere with a scoring console or use one without the Organizer's authorization;
- use the Services for any commercial purpose other than running your own events.
If you see something that puts a child at risk, contact the authorities first, then tell us at [SAFETY CONTACT].
12. Your content
"Your content" is what you add: team and event details, bios, club pages, images, notes and messages. You keep ownership of it. You give AthletECO a non-exclusive, worldwide, royalty-free license to host, copy, display and adapt it to operate, improve and promote the Services, for as long as it is on the Services and for a reasonable time afterward in backups.
You confirm you have the rights to what you upload. We may remove content that breaks these terms or the law. When you remove an image, we delete the file, not only the listing.
13. Our services at events
Game data. At an event using a GameStation, the scorer at the table creates the official game record: score, clock, fouls and who scored. That record is the Organizer's official result. We do not guarantee it is free of error. Corrections are made through the Organizer.
Statistics and rankings. Statistics, badges, rankings and leaderboards are calculated from game records. They are information, not a judgment of any athlete's ability, and we may change how they are calculated.
Combine measurements and identity verification. Our staff may measure height, wingspan, vertical jump and broad jump, and may check documents to verify an athlete's age. Participation is voluntary and requires a parent's or guardian's consent for a minor. The measurements involve physical exertion; see the Liability Waiver.
Equipment. Consoles and displays we rent to an Organizer remain ours. The Organizer is responsible for reasonable care of them while in its venue, and for loss or damage other than ordinary wear. [RENTAL TERMS — TO BE ATTACHED AS AN ORDER FORM OR SCHEDULE.]
Advertising between games. [PLANNED, NOT BUILT.] A console may in future show sponsor messages between games. They would not use anyone's personal information.
Text messages. AthletECO texts only people who turn texts on: parents, guardians, coaches and team staff who choose schedule texts in Settings (athletecosports.com/sms/schedule), and its own staff who sign up for operational alerts (athletecosports.com/sms). Never athlete accounts. Reply STOP to stop and HELP for help; message and data rates may apply.
14. Photos and video at events
[TO BE DECIDED.] AthletECO staff may photograph athletes at combine stations for their athlete profile, and only with a guardian's consent (Liability Waiver, Part A, media consent). Organizers may have their own media release. We do not take or publish video today.
15. Other services and links
The Services link to maps, social media profiles and other sites, and rely on outside providers to operate. We are not responsible for those services or their terms.
16. Suspension and closing an account
You may delete your account at any time from Settings. We erase your login and personal details and remove your links to athletes and teams; games, results and payment records you took part in stay, attributed to "Deleted user", because they are other people's records too. If you are the only owner of a club or organization, you must hand it on or ask us to close it first.
We may suspend or close an account, or remove a role, if you break these terms, if we must by law, or to protect athletes, families or the Services. Where it is safe and lawful, we will tell you why and give you a chance to respond. Sections that by their nature should survive closing an account do.
17. Disclaimers
The Services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted or error-free, that a console will work without internet or power, that game records, statistics or rankings are accurate, or that any Organizer, trainer, coach or user is safe, qualified or who they say they are.
18. Limitation of liability
To the extent the law allows, AthletECO is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, however caused.
To the extent the law allows, our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid AthletECO in the 12 months before the claim, and (b) [AMOUNT, e.g. $100].
Nothing in these terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct, or personal injury where the law does not allow it.
19. Indemnity
If you are an Organizer, you will defend and indemnify AthletECO against claims arising from your events, your content, your use of athletes' and families' information, or your breach of these terms, except to the extent a claim is caused by AthletECO.
20. Disputes
Governing law. These terms are governed by the laws of [STATE], without regard to conflict-of-laws rules.
Informal resolution. Before filing a claim, contact us at kurtis@athletecosports.com and give us 30 days to try to resolve it.
[OPTION A — Arbitration.] Any dispute will be resolved by binding individual arbitration under [RULES], except that either party may bring an individual claim in small claims court. You and AthletECO waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these terms by writing to 6 William Albert Way, Lovettsville, VA 20180.
[OPTION B — Courts.] Any dispute will be resolved in the state or federal courts located in [COUNTY, STATE].
21. Changes
We may change these terms. For a material change we will tell account holders by email or in the Services at least [NOTICE PERIOD] before it takes effect. Continuing to use the Services after that means you accept the change.
22. General
These terms, the Privacy Policy, any waiver you sign, and any order form for equipment are the whole agreement between you and AthletECO about the Services. If a part is unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them with our business.
